CASE STUDY:

A USI manufacturing client produced air filtration units used in heavy industrial plants. Three of the filtering units failed to perform to specifications and were shut down—causing the air in a customer’s plant to be out of regulatory compliance. The plant was subsequently closed for three days and the plant owner suffered a $300,000 financial loss from the closure. The plant owner sought recovery of their financial loss from USI’s manufacturing client for failure of the air filtration units. USI’s placement of a Manufacturer’s Errors & Omissions (E&O) policy covered the loss, preventing a financial disaster for both parties.
